Section 44
Health protection of workers working in hazardous areas
: (1) In order to protect the health of workers working in hazardous areas, the relevant employer shall adopt safety measures according to the prevailing law.
(2) Employers of workers or employees working in hazardous areas as per sub-section (1) shall have health insurance in accordance with prevailing laws.
(3) If an employee or worker is injured or dies due to the use of tools, equipment or any other material at the workplace in a hazardous area as per sub-section (1) or if any health worker suffers a serious infection or illness in the course of providing services, the relevant employer shall arrange for medical treatment and appropriate compensation. .
(4) The concerned employer shall provide health workers, employees or workers working in hazardous workplaces as per sub-section (1) with risk allowance as prescribed by the Government of Nepal.
